Graphic Warnings For Guns? New York Lawmakers Push Tobacco-Style Labels At Gun Shops

Putnam County Executive Kevin Byrne has issued a scathing critique of newly introduced New York legislation that would require graphic, “tobacco-style” warning labels to be provided with firearm permits and displayed in gun shops.


ALBANY, NY — The legislative battlefield in Albany has shifted toward a new, visual frontier. On March 3, 2026, State Senator Erik Bottcher (D) introduced Senate Bill 9334, a provocative measure that seeks to treat firearms similarly to tobacco products by requiring “graphic warnings” at the point of purchase and licensing. The bill, and its Assembly companion A10485, would force licensing officers and firearms dealers to provide imagery depicting the “health and safety risks” of rifles, shotguns, and handguns.

Putnam County Executive Kevin Byrne, a Republican and former state assemblyman, wasted no time in condemning the proposal. In a statement released shortly after the bill moved to the Senate Codes Committee, Byrne argued that the measure is an intentional effort to shame law-abiding citizens for exercising their constitutional rights.

“This isn’t about safety — it’s about stigmatizing responsible citizens,” Byrne said. “Law-abiding gun owners in New York already face some of the toughest restrictions in the country, and now lawmakers want to slap graphic warning labels on them like they’re buying cigarettes”.

The Details of SB 9334

If signed into law, the bill would fundamentally change the retail environment for New York gun owners:

  • Graphic Permitting: Licensing officers would be required to provide the imagery whenever a permit is issued or amended.
  • Retail Requirements: Firearms dealers would have to display unobstructed graphic warning signs adjacent to existing written notices.
  • Hefty Fines: Dealers found in violation would face a civil penalty of $5,000 for a first offense and $10,000 for subsequent violations within a year.
  • Design Mandate: The Department of Health and the Department of Mental Hygiene would be responsible for designing the graphic warnings.

From NYC to the State Capitol

The push for state-level graphic warnings follows a similar move by the New York City Council in late 2025, which mandated that city gun shops display images such as a child reaching for a handgun. While proponents argue these visuals are more effective than written text in preventing suicides and accidental deaths, opponents like Byrne contend that Albany is ignoring criminal activity in favor of burdening legal owners.

As of mid-March 2026, Senate Bill 9334 remains under review by the Senate Codes Committee. Given New York’s current political climate, the bill’s progression is being closely watched by Second Amendment advocacy groups as a potential template for other restrictive states.
